nokhitha (نوخذة) is a Kuwaiti online marketplace for boats, jet skis and marine gear, operated from the State of Kuwait. Contact: abdulwahab@nokhithakw.com. By creating an account or using the app, you accept these terms. If you do not accept them, do not use the app.
nokhitha is an advertising venue. It connects buyers and sellers and does nothing more. nokhitha is not a party to any sale, does not own, hold, inspect or deliver any item, does not hold or transfer buyers' money, and does not guarantee any item, price, or person. Every deal is made directly between buyer and seller, at their own responsibility.
Boats and jet skis in Kuwait are subject to registration under the applicable maritime regulations. The "registered" badge on a listing repeats what the seller declared — nokhitha does not verify it. Checking a craft's registration papers, and transferring ownership with the competent authority, is entirely between buyer and seller.
Using nokhitha is currently free. If listing fees or optional paid features are introduced, they will be shown clearly in the app before you commit to any charge, and these terms will be updated first.
Content you publish stays yours. By publishing it you give nokhitha a non-exclusive licence to store, display and promote it as part of operating the service. The nokhitha name, logo and app design are ours and may not be copied or used commercially without written permission.
The app is provided as it is. To the extent Kuwaiti law allows, nokhitha is not liable for losses arising from deals between users, from the truthfulness of listings, from another user's conduct, or from interruptions of the service. Nothing in these terms removes rights that Kuwaiti law grants you and does not allow to be waived.

We may update these terms; material changes will be announced in the app and apply from the date shown above. You can stop using nokhitha at any time and delete your account inside the app (Profile → Delete account).
Under Kuwait's digital commerce regulations, a buyer may withdraw from a completed purchase within 14 days of the date of purchase, provided the item is returned in the condition it was sold and is not of a nature that changes with use. This right operates directly between buyer and seller — nokhitha is not a party to the sale, holds no money, and does not process returns; the parties settle it between themselves under the supervision of the Ministry of Commerce and Industry's consumer protection rules.
A dispute about an item traded through listings on nokhitha is referred first to the dispute settlement committee of the Ministry of Commerce and Industry, constituted under Kuwait's digital commerce regulations. If settlement fails, the courts of Kuwait have jurisdiction. Disputes about these terms or the platform itself likewise belong to the courts of Kuwait.
These terms are governed by the laws of the State of Kuwait, and the courts of Kuwait have jurisdiction over any dispute. These terms are issued in Arabic and English; the Arabic text prevails if the two differ.

نوخذة منصة إعلانية تربط البائع بالمشتري ولا تتجاوز ذلك. نوخذة ليس طرفاً في أي بيع، ولا يملك أو يحوز أو يعاين أو يوصّل أي سلعة، ولا يستلم أو يحوّل أموال المشترين، ولا يضمن أي سلعة أو سعر أو شخص. كل صفقة تتم مباشرة بين البائع والمشتري وعلى مسؤوليتهما.
تخضع القوارب والجت سكي في الكويت للتسجيل وفق الأنظمة البحرية المعمول بها. شارة «مسجّل» في الإعلان تكرر ما صرّح به البائع — ولا يتحقق نوخذة منها. فحص أوراق التسجيل ونقل الملكية لدى الجهة المختصة أمر يخص البائع والمشتري وحدهما.
استخدام نوخذة مجاني حالياً. وإذا استُحدثت رسوم إعلانات أو ميزات مدفوعة اختيارية فستظهر بوضوح في التطبيق قبل أي التزام بالدفع، وتُحدَّث هذه الشروط أولاً.
المحتوى الذي تنشره يبقى ملكك، وبنشره تمنح نوخذة ترخيصاً غير حصري بتخزينه وعرضه والترويج له في إطار تشغيل الخدمة. أما اسم نوخذة وشعاره وتصميم التطبيق فهي ملك لنا ولا يجوز نسخها أو استخدامها تجارياً دون إذن كتابي.
يُقدَّم التطبيق كما هو. وفي الحدود التي يجيزها القانون الكويتي، لا يتحمل نوخذة مسؤولية الخسائر الناشئة عن الصفقات بين المستخدمين، أو عن صحة الإعلانات، أو عن سلوك مستخدم آخر، أو عن انقطاع الخدمة. ولا تنتقص هذه الشروط من أي حق يمنحك إياه القانون الكويتي ولا يجيز التنازل عنه.
ما نجمعه ولماذا مبيّن في سياسة الخصوصية، وهي جزء من هذه الشروط.
قد نحدّث هذه الشروط، وتُعلَن التعديلات الجوهرية داخل التطبيق وتسري من التاريخ المبيّن أعلاه. ويمكنك التوقف عن استخدام نوخذة متى شئت وحذف حسابك من داخل التطبيق (حسابي ← حذف الحساب).
وفقاً لأنظمة التجارة الرقمية في الكويت، يحق للمشتري الرجوع في الشراء خلال ١٤ يوماً من تاريخه، بشرط إعادة المبيع بالحالة التي بيع عليها وألا يكون من الأشياء القابلة للتغيّر بطبيعتها. هذا الحق يمارَس مباشرة بين البائع والمشتري — نوخذة ليس طرفاً في البيع ولا يستلم الثمن ولا يعالج الإرجاع؛ ويسوّي الطرفان الأمر بينهما وفق أنظمة حماية المستهلك لدى وزارة التجارة والصناعة.
أي نزاع حول منتج تم التعامل عليه عبر إعلانات نوخذة يُعرض أولاً على لجنة تسوية المنازعات لدى وزارة التجارة والصناعة المشكَّلة وفق أنظمة التجارة الرقمية، فإن تعذّرت التسوية اختصت محاكم الكويت. أما المنازعات المتعلقة بهذه الشروط أو بالمنصة نفسها فتختص بها محاكم الكويت.
تخضع هذه الشروط لقوانين دولة الكويت، وتختص محاكم الكويت بأي نزاع. صدرت هذه الشروط بالعربية والإنجليزية، والنص العربي هو المعتمد عند الاختلاف.
